The emergency bill the prime minister is published on Wednesday does not yet involve leaving the European Convention of Human Rights and does not extend to “notwithstanding clauses” which would allow ministers to ignore international treaties such as the ECHR .
Two Options Proposed:
The first option aimed to disapply only the UK’s Human Rights Act in UK asylum claims. However, this would not would still allow appeals/challenges by individual applicants.
The second removed the right of judicial review for applicants and included “notwithstanding clauses”. This would allow ministers to essentially disregard the European Convention of Human Rights and other international treaties in the area of asylum.
This emergency legislation is seemingly aiming for a middle ground to progress the Rwanda scheme. This comes following much controversy and push-back from many in parliament. A debate regarding the bill is scheduled to take place next week.
